These General Purchase Conditions regulate the use of the website www.balissi.com (hereinafter “the website”), owned by MODAS BALI SL, a limited liability company with its registered office at Plaza Goya 1, 29620 Torremolinos, Málaga, under the commercial brand Balissi. The customer’s use of Balissi’s online store services implies acceptance of the General Purchase Conditions in the version published by Balissi at the time of purchase. Therefore, customers should read these General Conditions before making a purchase.

SCOPE OF THE CONTRACT

These General Purchase Conditions apply to the sale of all Balissi items through its website to consumers who can receive orders in Europe (Eurozone only). Balissi informs that its website is intended exclusively for individuals over 18 years of age. Balissi reserves the right to cancel a customer’s access account if fraudulent, speculative, or bad faith activities are detected when using this service.

PURCHASE LIMIT

For security reasons, purchases cannot exceed €1,500 or contain more than 40 items per order.

PRICE

Applicable prices are those indicated on the website on the order date. Prices are detailed for each item and include VAT (Value Added Tax), IGIC (General Indirect Tax for the Canary Islands), or IPSI (Tax on Production, Services, and Imports in Ceuta and Melilla), as applicable. The shipping costs are detailed separately at the time of order placement.

PAYMENT

Payment must be completed at the end of the purchase process and is a prerequisite for order confirmation. Payments cannot be made at a later time. Deferred payment methods such as cash on delivery, bank transfer, or in-store payment upon order pickup are not accepted.

Accepted Payment Methods: Purchases can be paid using Visa®, Mastercard®, or American Express® credit cards, as well as 4B or 4B Maestro debit cards, and PayPal. The choice of payment method is made during the purchase process on the corresponding screen. The customer must notify Balissi of any unauthorized or fraudulent charges on the card used for purchases via email or phone as soon as possible so that appropriate measures can be taken. Payment providers may apply anti-fraud measures that result in the rejection of certain transactions. Balissi is not responsible for the application of such security policies.

DELIVERY

The estimated delivery time is generally 1 to 2 business days from the date of purchase. Orders will be delivered to the address provided by the customer, with the following conditions:

Home Delivery:

  • Standard Shipping: Free within the Spanish mainland.

  • For deliveries to Ceuta and Melilla, the customer must pay any customs fees and taxes generated by the order. These costs are paid upon receipt of the order and are not included in the product price.

  • For deliveries to the Canary Islands, the customer will not have to pay additional charges beyond the shipping costs. However, Balissi is not responsible for any taxes and/or customs fees that may arise.

The address provided by the customer can be a home, workplace, or any other specified location. The billing address and shipping address do not need to match. Our transportation provider will send a notification indicating the delivery date and providing options to reschedule or change the delivery address. On the day of delivery, another notification will be sent with delivery details.

Delivery Issues: If delivery cannot be completed due to the recipient’s absence, the courier will leave a notification and attempt to contact the recipient. After two failed attempts, the customer must contact the courier service to arrange delivery.

Delivery times may be affected by third-party factors or during high-demand periods.

EXCHANGES AND RETURNS

There are different procedures for exchanges, which we describe below, including their costs and conditions. You have 14 days from receipt of the product(s) to make an exchange.

  • In a physical store: Present the receipt received via email upon purchase along with the product to be exchanged.

  • Online store: Contact our Customer Service via phone or email at info@balissi.com, and we will arrange for the product(s) to be picked up at your designated address.

  • Exchange: An exchange is considered a replacement of the same product for a different color and/or size.

  • Return: A return is due to a defect, faulty item, incorrect product received, or any other reason beyond the previous ones.

For certain products, the following conditions apply:

  • All products to be exchanged must be in their original packaging, except for defective or faulty items.

  • The first exchange is free of charge. Any additional exchange will incur a cost of €4.90, which may be deducted from the order price. Refunds will be issued once the returned merchandise has been received and inspected.

  • A courier will be sent to collect your return from the address provided.

PRODUCT AVAILABILITY

If supply issues arise or a product is out of stock, the customer will be informed immediately, and the amount paid for the unavailable product(s) will be refunded. MODAS BALI SL will refund the corresponding amount without undue delay and, in any case, within 14 calendar days. The refund will be issued using the same payment method used for the purchase. Stock availability displayed on the website for physical stores is indicative and may vary.

MODAS BALI SL Customer Service will respond to your complaint as soon as possible, and in any case, within a maximum period of one month.

MODIFICATION OF GENERAL PURCHASE CONDITIONS

MODAS BALI SL reserves the right to modify these General Purchase Conditions at any time. No modification will affect orders already in progress.

FORCE MAJEURE

MODAS BALI SL’s fulfillment of all or part of its obligations will be suspended in the event of force majeure or unforeseen circumstances that prevent or delay compliance. These include but are not limited to war, riots, insurrection, social disturbances, strikes of any kind, and supply issues beyond MODAS BALI SL’s control. MODAS BALI SL will inform the customer of such force majeure or unforeseen events within seven days of occurrence. If the suspension lasts beyond 15 days, the customer may cancel the order in progress, and a refund will be issued according to section 6 of these General Purchase Conditions.

APPLICABLE LAW AND JURISDICTION

These General Purchase Conditions are governed by Spanish law. Notwithstanding the above, non-resident consumers in Spain are also entitled to the protection granted by the mandatory legal provisions of their country of habitual residence. The parties agree to submit, at their choice, for conflict resolution and waiving any other jurisdiction, to the courts corresponding to the customer’s domicile.

BLACK FRIDAY

General Purchase Conditions may be subject to alterations due to high sales volume, shipping delays, or stock discrepancies or errors.
